    can social security be used to pay child support in CA

    My husband worked in CA for more then 10 years.He was ordered to pay child support last year by CSSD , ca.

    now he is not paying child support and has been detained in other country for a criminal case. He is not showing any incom since one year and says he is not earning anything as he is in other country.He has also moved his bank account funds in that country from ca, usa.He doesn't have any fixed asset in CA either.

    Now can I request the CSSD ca to use his social security benefits ( As he has wroked for more then 10 years and earned good ss) as he has not supported his child since 2006?

    What benefits? Unless he's over 65, he's not getting any benefits from SS.

    His SS can't be "attached" unless he's actually receiving SS payments.

    I replied at your other thread but no, you cannot claim any SS if your husband is not entitled to receive benefits. He must be at retirement age (62+) or be disabled and then disability takes a year to push through and not sure if he is even eligible if he is incarcerated in another country.

    He is under 40 , usa citizen since 2007.........but has worked more then 10 years in USA and has sufficient amount in SS  .

    Which Social Security benefit?

    Social Security Disability Insurance (SSDI) or

    Supplemental Security Income (SSI)

    You are confused. One does not get entitled to any SS benefit simply because they contributed to the system. He must retire at age 62-65 (probably 65) or be declared disabled which he cannot do since he is incarcerated and not even in the US. So neither him or you are entitled to any SS benefits.

    SS is not a savings account. That is not money he currently has access to and neither does anyone else.
