    Overworked in Oregon

    Ive searched and browsed everywhere, every link and site possible and I cant find an answer to my question. 

    My employer works many of my co-workers 5 days, then 5 days again with only 2 days off at the beginning of the week and the tail end of thier second week. 

    For example, Joe goes to work on tuesday, havint sunday and monday off, then he works the rest of the week till saturday, gets his new schedule and sees hes working sunday through thursday the next week with no days off, for a total of 10 days straight.

    I know an employer makes his schedule from sunday to saturday and thats considered a work week, but is it legal to work someone more than 5 days straight like that.  Im very tired and I feel the exhaustion is effecting my work ability.

    Also, thier schedual involves working people mornings one day and the next day having the work nights then coming back in in the morning with no more than 12 hours between shifts. 

    Im very curious as to whats legal. 

    Im scared to confront my employer about the difficulty of working 10 days straight for fear of being fired or laid off.  Id feel more comfortable in addressing this issue with HR if I had some kind of law backing me up.

    Was the Oregon Bureau of Labor on your list?

    I imagine that somebody there can answer your question and cite you a statute if one applies.

    It's probably legal for an employer to work you 10 days on and 2 days off as long as you are getting paid properly for overtime and get the legally required breaks.

    Why not call up tomorrow and ask?

    There is a very small handful of states in which an employee is guaranteed one day off in every seven. Note that this is NOT the same thing as every seventh day off; an employee could work as many as 12 days in a row and still be in compliance. For example:

    Off Sunday, work Monday, Tuesday Wednesday, Thursday, Friday, Saturday

    Work Sunday, Monday, Tuesday, Wednesday, Thursday, Friday, off Saturday

    In all other states, INCLUDING Oregon, you could technically be required to work 365 days a year and as long as you were paid the appropriate overtime, neither state nor Federal law would blink an eye.

    The schedule you describe is legal in all 50 states.

    Im  not being paid over time, and many of my co-workers work the same length of time and have been there a fwe years.  Thing is, they get reprimanded if they go over thier 40 hours per work week, they say, "we get in trouble if we pull over time"  yet the company wont hire more people to help with the work load, so everyone is doing the work of at least 2 people.

    As long as our government is throwing money at greedy companies who pay outreagous bonuses wile filing for BK protection don't expect it to get any better any time soon.

    If the other employees are hourly and you are salaried then that explains their reason.

    You have 2 options.

    1. Deal with the OT
    2. Find a new job.
