    Private Street question in PA

    I live at the end of a private street. I am responsible for the upkeep of the street (paving/winter mainainance/etc.). Th street is only 28' wide.

    On my land survey, It states that my street should be 40' wide. The issue is with a couple of things. The remaining 12' of land on the other side of the street, I assumed would be mine to take care of because it is marked to be originally the street, but was never widened to the original 40'.

    The borough informed me that it isn't mine, it is the other land owners on the opposite side of the street (their back yards are against my street, so their address is on another street). I was confused because their survey shows that they don't own the land.

    The other issue is that the private street I live on is over 50 years old. I was informed (or heard) that the rights to develop by the borough are over do to the statute of limitations to develop.

    I need some advice before I have to hire a land attorney. THis is in Pittsburgh, PA.

    It's not the survey that says what you own, it's your deed.

    I suggest you check the legal description on your deed to determine the boundaries (metes and bounds) of what you own.

    The survey might or might not conform to the deed, but your deed would be the proof of ownership.
