    Concerning my former job

    I was fired this week from my job as a resident aide. I firmly believe that I was set up, considering that on the schedule that came out the day before my firing had a new employee with no hours, but within an hour of my firing the new schedule had him with hours. Is this legal?

    Also, is the reason I was given for my firing legal? Reason: I am an instigator and a gossip among staff. The reason for my firing Thank God had nothing to do with my care with the residents.

    Also is it legal for a employer to hire a known felon at an assisted living community after doing a criminal history check?

    What can I do to get attention to the fact that this person above has been known, has been witnessed to an episode of abuse with an elderly resident and management hasn't done anything but give her a paid leave of abscence?

    Perfectly legal. Unless you work for a Union or are under a CBA the company can fire you for any reason or none at all.

    Gossip, black hair, didn't shave, forgot to brush you teeth, Used wrong hair gel are all valid reasons to terminate you.

    Age, race, religion, National Origin, etc... - Nt  valid reasons to fire you.

    Known felons are people too and need jobs - I don't know if your state restricts what type of jobs felons can hold. You might be able to find this out by searching your states DOL website - if they have one.

    Call the local media, write your local paper, call your department of labor - BUT you better be able to prove it or you could get slapped with a slander suit pretty darn quick.

    You do not have any idea what happens behind closed doors - it's possible that the company has taken action and the gossip train and rumor mill never got wind of it.

    File for unemployment and pray the company does not block it.

    Pray that when you apply for another position that the company does not make it hard for you to find work.

    It's p[erfectly legal to fire you for being a gossip and to hire your replacement before you are fired.

    You can complain to the state licensing agency if there is abuse going on. Of course they will wonder why you only reported it after you were fired.

    I didn't wait to report the abuse. I reported it several months ago to the local DA and a government office. It has also been reported by several other employees, but so far nothing has been done about it.

    Have you considered that they terminated you because you reported the abuse?

    If they fired you because of that you may have a case but I am not sure. You would have to look up whistle blower laws for your state.

    Good analogies, but the one that might carry a thorn is "didn't shave" if someone's reason for not doing so is based upon his religion.

    Thx - forgot about the not shaving for religion.
