    Dismissal

    Auto accident on 10/6/06 in Glendale, CA.  Other party drove at a high rate of speed around a corner hitting my car as I entered the center turn lane in the center of the road.  I hired an attorney.  I replaced the 1st attorney after 1 year of lack of work and unprofessional behavior.  In 1/08 a default judgment was awarded to me.  The other parties’ insurance carrier claimed he was not insured by them and refused to pay now the same insurance company is defending him and in 1/09 they got the default set aside.  I hired a 2nd attorney in 2/08.  In Jan. 09 he wanted out and in 6/09 he was granted the motion.  During the months when he was trying to be relieved, the defense was sending motions to lawyer #2, that he was not forwarding to me and not responding to.  I have tried to find a 3rd attorney without success.  Due to the fact that I am unable to find an attorney and the defense motions, it was pointed out to me that there is irreparable harm to the case and not enough money to make it worth pursuing.  The defendant only had the state minimum.  I sent a letter to the defense attorney and they have agreed to waive costs, if I file the dismissal. Can either of the attorneys I hired come after me for their expenses?  If this is dismissed with prejudice can the defendant try to sue me?  I was able to find the dismissal form online, but how do I go about getting it filed with the court?
