    Child's Age to Testify?

    At what age may a child be heard by the judge in a custody hearing in Oregon?  My stepsons are 10 and 8 and would like to speak to the judge regarding where they will live.  I know they can't choose, but at what age will their testimony be allowed and/or taken into consideration?

    They can testify at any age.

    18.

    That's when they become adults.

    Until then they are minors and it's a myth to believe that their wishes will make any difference to a judge.

    The children's testimony will be taken into consideration;  it will be one factor of many that the judge will take into consideration when making a decision.
