    petition to remove name from sex offender registry

    my fiance was adjudicated as a juvenile (age 13) of csc 2nd degree....he doesn't qualify for expungement because it was 2nd degree, the judge told him to file for a petition to have his name removed from the PSOR, one catch, I guess the government only offered a small window of opportunity for this to be done and if you didn't do it in that window you missed the boat ( I live in Michigan)  He was never informed of the opportunity to file this petition.  he has a clean record, he is 26 years old....can we file a motion to have name removed and change of restrictions, giving adequate cause (death threats etc..)  From what I've researched it is the juvenile justice specialists job to inform juvenile sex offenders of all registration changes and any opportunity to have their name removed etc...why was my fiance not informed of this once in a lifetime opportunity and what can we do....I am preparing to file a motion with the court if that is possible....I'm willing to do anything possible.....

    This is probably not what you wanted to hear, but YOU should not prepare or file any motions or any other court documents for your fiancé. That constitutes the practice of law, and doing that without a license to practice law puts you in violation of the law.

    What he needs to do is consult a criminal defense attorney familiar with the state's sex offender registration laws for help. This is too important to try as a do-it-yourself project. If your fiancé messes this up, he might not get another shot at it.

    Laws change all the time.  An attorney is not expected to notify a client every time a law changes after the case has been dispo'd.  The MI law that allows for petitions to be relieved of the duty to register was enacted in 2004 and amended in 2011 (28.728c) .  Whether or not removal of a name is possible depends upon not just the charge.  As TaxAgent already noted, your fiance needs to consult a local criminal defense attorney familiar with the sex offender registry laws.

    Remember, your fiancé may not be telling you the entire truth.

    My suggestion to you is to direct him to a criminal defense laywer who can then dig into the court records and find out exactly what happened and what are the options. Then your fiancé can make an informed choice as to how to proceed.

    I also suggest you put any marriage plans on ice until this is resolved. Marriage to a sex offender may severely limit your own options as to places of residence, employment, etc.
