• Re: What should the judgment creditor do?

Yes. But it's not written in stone. Somewhere in there I'd be calling the claim rep after receiving my copy of the judgment and asking if there's going to be an appeal and, if not, when I could expect my check and how did he want the Satisfaction of Judgment handled. Might move things along sooner than just waiting and not doing anything

  • Re: Collecting expenses for travel to small claims court

I'm not a lawyer and I'm not giving legal advice (even though it might seem like that sometimes) but I have bought and sold plenty of cars in my lifetime. Here's what I would do if I got a letter like that from a buyer (if it didn't come from or through the court). I would ignore it and not get into any discussions with him at all about

  • Re: NY/NJ sales tax dispute on new car purchase

I think I would start with a tax accountant that practices in both NY and NJ and see what he can tell you about both situations. He would probably know the right kind of attorney to refer you to if an attorney would become necessary.
I sell used sewing machines online - I'm not a dealer. I obtain them locally and resell them for profit.
Then you ARE a dealer. You're a dealer in used sewing machines. A rose by any other name... Just wanted to point that out, even though it's not relevant to your problem. [quote user="aaronfaith"

  • Re: Tenant Judgment in Bankruptcy Case

Please stop opening new threads on the subject of things related (even distantly) to your bankruptcy. Makes it difficult to go back and review the history. When you post a new question on an existing thread, and it doesn't get responded to in a couple of days like this last one, just add another reply to the same thread and it goes back to the top

Sorry, I didn't catch the question Wed in your other post but I'll answer it there and have the moderator get rid of this one.
Yes.... unfortuantly my wife has been writing a check to my mother-in-law. I suppose in an audit this information would not do us any good. The IRS would probably laugh in our face if we told them that.
I don't think that things are all that bleak. You wife's name is on the loan and the mother is

  • Re: Would this be considered a breach of contract?

Correct, there's no law (that I know of) requiring a driver license to own, title, or register a car. However, insurance companies require you to have a driver license before they will insure the car at preferred or standard rates. If you are willing to pay high risk rates (double or triple), you can probably find companies that write insurance
1. Record the judgment at the courthouse. 2. File a lien against any real estate the debtor owns. 3. Contact the credit reporting agencies and record the lien with them.
I caution against doing any of that until you are actually compelled to engage in post judgment enforcement efforts. If you do all that prematurely
Do the statues apply to Living Trust that is not being probated? It was my understanding that the reason for a Living Trust was to avoid probate expenses, etc.
Trusts don't get probated.
I assume anyone who is going to inherit can start a probate, is that right?
Correct
