My understanding is that the 50/50 division is what you get if things are contested. However, if you agree amongst yourselves to something other than that, the court would be willing to allow your husband to sign away his rights.

Contempt is a quasi-criminal issue and involves higher standards of proof. You need to show that there is a valid order, that your opponent knows about the order and has the ability to comply. That last one can take work to prove if your opponent is careful and crafty. In my experience, the courts tend to want to see problems resolved rather than raised

Drew, doesn't spousal privilege merely allow a person to refuse to testify about communications with their spouse? It sounds like the opposite is desired here. Judge has it right, I think. Poster wants to bring up matters that spouse has not tendered as conditions relevant to the case, presumably. In that case doctor-patient privilege applies as

OK, so the story out of DCSS is that the sum demanded is achieved at by adding one month's obligation to the present day's balance (which does not account for payments arriving later in the month). That is according to their "rule book". Oddly enough, that is supposed to represent money that is "past due" based on future

Of course the burden rests on me; that is the way that the system is set up. But that takes court time and the time and expense of DCSS attorneys, too, which I would think would be more expensive than hiring qualified accountants. In CA the courts are already closing the third Wednesday of every month just to save money. We went through this whole mess
