• Re: Renters Insurance Claim. Invasion of Privacy ?
Then claim gets denied for non-compliance with the cooperation clause and away we go. :-)
That's fine, I and my colleagues love going after insurance companies, especially when they act unreasonably :-)
It would have had a trickel down effect and exposed both judges, 7 lawyers and TREASON!
Whatever else went on here, it was not treason. Treason has a very specific definition. 18 U.S.C. § 2381 is the federal statute that makes treason a crime. It states: “Whoever, owing allegiance to the United

 • Re: Renters Insurance Claim. Invasion of Privacy ?
My response would just be that all of the information is required to determine if the insured had financial motive to file a fraudulent claim. I would not address each item separately, even if asked.
And if representing the insured I would say that even in looking to determine fraud that list of requests
Its been a great ride since Prairie Law. Anyone know what happened to the gentlemen who ran that site?
Kevin O'Keefe was the founder of Prairielaw.com. He sold it to Lexis-Nexis at the end of 2000 (didn't realize it had been that long ago) and after working for Lexis-Nexis briefly he went on to found LexBlog

 • Re: How long is a will valid after death if another death occurs
Why does the way it works out change is Mary's daughter dies within 5 days of her mother? Does the 5 days vary from state to state?
Yes, it varies by state. Note, too, that the will can override that and provide a different rule. For example, the states in which I practice also have the 120 hour rule. But
Q: Can't plaintiff attorney file suit with no intention of going to trial due to the cost of depositions, etc?
Not ethically, no.
How did the insurance company know that the plaintiff would follow through with their filing, it may have been a bluff. They could have just sat
Given Martindale’s apparent apathy about the message boards I have wondered for awhile why it doesn't just pull the plug on these boards altogether.
Well, the forums are indeed closing at the end of the month. I received the e-mail announcing that today. I hope my comment above from a few weeks ago
