    You CANNOT have those funds released to you. The purpose of the set-aside is for payment of medical expenses and that's the only thing that money can be used for. See:

    Insurance will want to settle but it will be for far less that you will be expecting. They already have lawyers. You would be wise to hire counsel NOW. The longer you wait, the less insurance is going to offer because they know you only have up to the statute of limitations to file suit and they will drag it out. The longer you wait to hire counsel

    Loss of use covers a reasonable cost to rent a similar vehicle for the amount of time reasonably necessary to repair the vehicle's damage. You do, however, have a duty to mitigate damages. I suspect the hang up is more over the time it took to repair where the estimate was 5 days particularly since you didn't have to be in a hurry for the repair

    WHY would he sue you? He's been paid more than what he earned and he doesn't have to deal with you. Since he didn't do anything about the asbestos and he didn't damage the already faulty pipes, what you allege he said really isn't relevant.
